Allahabad High Court orders ₹5 lakh death benefit for unmarried sister

Allahabad High Court directed Oriental Insurance Company to pay ₹5 lakh under Mukhyamantri Kisan Evam Sarvahit Bima Yojana to an unmarried sister as the legal heir of her deceased brother, within four weeks of production of a certified copy of the judgment. It held that she was not barred from the personal accident death benefit because sisters are not listed as covered family members.

The accident took place on May 18, 2019, during the policy period from September 14, 2018 to September 13, 2019. The court found no dispute between rival heirs; under the scheme, a succession certificate is required only when succession is disputed. Read the judgment.

Ruling concerns receipt of a death benefit. It does not add sisters to those covered for their own accidental injury or medical treatment.
